      General principles to pricing mechanisms

Executing to article (11) section (A), and according to Article (21) of the Industry and Trade Law No. (18) dated 1998 and its adjustments. The following principles of pricing mechanisms are adopted.

 

First - General principles to pricing mechanisms

 

Retail price of all products in the market must be publicized, whether the price is fixed or not. If that proved difficult, then prices may be publicized by one of the following methods, and according to type of activity:

 

1-    By posing a price list of all merchandise for sale

2-    Using the importer or the manufacture’s invoice, or by a computer produced listing that would show the consumer price (for behind –the-counter sales).

3-    Prices attached to merchandise by importing or manufacturing company if the seller adheres to these prices. However, to sell for a price higher than that attached, the seller must publicize the new price and scratch off the attached price.

4-    One price may be publicized for each unit of identical merchandise, or for each brand, or for a group of brands sold for the same price.

5-    One price may be clearly advertised at the entrance of the store, or inside if the price unified for all merchandise within.

6-    Prices of services are excluded, and need not to be publicized.

7-    Wholesalers may publicize their prices using the following methods:

a-    Price listing inside the store.

b-    Statements prepared by importing company or by wholesaler.

c-     Prices on merchandise itself or on samples and prototypes.

d-    In cases where wholesaler sells directly to consumers, wholesaler must publicize price in manner suitable with the nature of trading activity of the store.

8-    Storehouses and warehouses are exempted from price publication.

 

Second – Trading sectors and methods of price publicizing for each sector

 

1-    Mini& Supermarkets, grocery stores:

Prices must be publicized on each unit of the merchandise, or on the shelves or display refrigerators for a particular brand, or for a group of brands sold for the same price.

 

2-    Popular (Folk) Restaurants (not classified)

All types of food and drink along with their prices must be included in a price listing that is placed in a visible location to customers inside the restaurants, in addition to table menus at the option of the restaurant owner.

 

3-    Butchery shops

a-  Prices of meats (including type and origin) must be publicized as follows:

·         Lamb (origin) grade one – Blue stamp

·         Lamb (origin) grade two – Blue stamp

·         Lamb (origin) grade three – Red stamp

·         Lamb (domestic) grade one – Green stamp

·         Lamb (domestic) grade two – Green stamp

·         Lamb (domestic) grade Three – Green stamp

·         Veal (domestic)

·         Veal (imported)

 

b-  Different types of meat from different sources of origin are publicized separately.

 

4-    Frozen meats and frozen food stores

Prices for frozen meats and frozen foods are displayed through a price listing, or on each type and brand, along with the unit of measurement (kg, piece, etc.)

 

5-    Fruit and Vegetable stores & Sale tents

The price is exhibited for each item separately or on one price’s list which hang on a clear location.

 

6-    Retail clothes & shoes stores

Prices are exhibited for each item shown in the window display and must match the prices attached on similar items inside the store. For items displayed inside the store, each piece is priced separately or each model or group of models if sold for the same price. It is permissible to display one price clearly at the entrance or inside the store if all merchandise in the store has the same price.

 

7-    Bakeries and Patisseries

Prices are displayed on each item or on one clear prices’ list.

 

8-    Sweet shops

Prices are displayed on each item or on one visible price listing that shows the price according to the weight, net weight or boxed weight (where boxes are available). Net weight of non-boxed sweets such as (Kunafa) must be that of the sweet itself not including container weight.

 

9-    Construction & hardware stores

a-    Prices for construction materials and safety tools must be publicized on the displayed items or on the entrance of the store or the front window.

b-    Classified lists of all items in the store must prepared either by the store owner, or the suppliers.

 

10-            Vehicle spare parts and accessories

a-    Classified lists must be prepared by the store owner or supplier of all parts in the store. Lists must include: part name, number, place of origin, retail price (to provide to customers should they so wish, for behind-the-counter items). Store owner may display retail price for each item individually as well.

b-    Prices for vehicle tires may be displayed on each tire individually, or on a group of tires with the same retail price, or on a clear location prices’ list containing the type of tire, its place of origin, and selling price.

c-     Prices for vehicle batteries may be displayed on each battery individually, or on a group of batteries with the same retail price, or on a clear location prices’ list containing the type of battery, its place of origin, its capacity and selling price.

d-    Prices for vehicle oils may be displayed on each brand of oil individually, or on oil bottles (cans) with the same retail price, or on a visible price listing containing the type of oil, its volume and its retail price.

e-    Prices must be displayed for all fire extinguishers exhibited for sale within the store.

 

11-           Electric Home appliances and equipment & electric wiring stores

Prices for all electric home appliances in the store must be displayed inside the store, in the window displays and showrooms. Display one price for each item is enough.

 

12-           Furniture stores

Each item in the store must be clearly priced

 

13-           Stationary and bookstores

Prices must be displayed for items exhibited in the front window and on the shelves or through a price listing prepared by the store owner or supplier.

 

14-           Gift and accessories stores

Prices are displayed for each piece individually, for each type having the same price, for a group of items having the same price or through a price listing.

 

15-           Carpet stores

Prices must be displayed including the unit of measurement (piece, meter squared) for each type or group. Place of origin must be included and any other feature of the carpet.

 

16-           Fabric shops

Prices must be clearly displayed including the unit of measurement (meter, yard, …, etc) on each item, kind or group.

 

17-           Vehicle showrooms

Selling prices for vehicles must be individually displayed on each vehicle including the type of vehicle, the model, the place of origin, other options, other features and retail price.

 

18-           Mobile (Cell) phones and accessories

Prices for each item, type, or group having the same price must be clearly displayed in the store or on a prepared list of prices.

 

19-           Home appliances

Prices must be displayed each item, type, or group of items having the same features.

 

20-           Calling cards shops

Prices for calling cards must be displayed through a price listing containing the type of card, its category, its value and consumer retail price. Seller may adhere to price fixed by issuing company plus the sales tax amount to the retail price.

 

21-           Trading exhibitions

Prices for each item, sort, or group of sorts selling for the same price must be clearly displayed inside the trade exhibitions.

 

22-           Herbal medicine shops

Prices must be displayed including the unit of measurement (ounce, kg, piece) either for each item, sort, or group of sorts selling for the price that are exhibited, or through a prices list that is visible to customers.

 

23-           Perfume and incense shops

Prices must be displayed on each container, group of containers or for each kind. A price listing may also be made containing the size of the container, the selling price and the type of ingredients if the retail price differs.

 

24-           Mobile carts and street vendors

Prices must be displayed for each item, sort, or group selling for the same price.

 

25-           Everything for JD---- stores

Only one price is displayed if all items and types are sold for the same price. However, if there are other items having different prices, this should be made clear on the window display and prices should be shown for each individual item or type having a different price.

 

26-           Gas container distributors

Official price of single container must be clearly displayed inside store.

 

Third – Price displays must be clearly state whether prices include sales taxes or not, so that customer is fully aware.

 

Fourth- In accordance with Article (11) of the Industry and Trade Law No. (18) of 1998, citations will be made for pricing display violations, and as follows:

1-    For not displaying prices of merchandise in store (completely not displaying prices)

2-    For not displaying the prices of the following items (items with un-displayed prices are named)

 

Fifth- This mechanism shall take effect as of date published in the Official Gazette.
